In this case complainant is a consumer of the O.P WESCO in his complaint, he stated that on dtd.17.04.2018 due to heavy wind and rain the wire of 11KV has been fail down upon wire of 230 Volt of high voltage in consequence of which his Meter, Invertor, TV and Fan got burnt causing loss of about Rs.50,000/-.  The complainant has filed this complaint against the WESCO alleging deficiency in service and prayed for compensation.

 

No doubt the O.Ps did not think wise to appear on valid service of notice of the complaint and the Forum has no alternative to adjudicate the case ex-parte against the O.Ps. though the O.Ps. had not appeared nor filed any written version still on perusal of the complaint petition, we did not find any improper service on the part of O.Ps. as the damaged goods of the complainant had been burnt due to Act of God and not due to deficient service of the O.Ps., hence the complaint has got no merit.

Accordingly the case in hand is disposed of.

Order pronounced in the open court today the 14^th day of August’ 2018. Free copy of this order be communicated to the concerned parties as per rule.
