MR. PRAVAT KUMAR PADHI, PRESIDENT:-

                The Complainant has filed this C.C.Case No. 1/2023 U/s-35 of C.P.Act, 2019  seeking a direction following relief:-

               ““Hon’ble Commission directed to the Ops to restraining power supply from effecting the transfer of consumer number in favour of the OpNo.4 with any other reliefs”.

                In the present case there is neither any consideration paid by Complainant for which we can treat the Complainant as Consumer U/s-2(7) of C.P.Act, 2019.

             The dispute between the parties is purely Civil in nature and this Commission has no power to entertain to settle any Civil dispute or restrain in any Civil proceeding. The matter  is already pending before Learned Civil Judge (Sr. Division) Kendrapara in C.S. No. 34/2022 as such we cannot encroach upon the jurisdiction of Civil Court and we find no merit in the present C.C.Case.

              With the aforesaid observations and direction the C.C.Case No. 1/2023 along with I.A 1/2023 are hereby dismissed and accordingly disposed off.

               Issue extract of the order to the parties concerned.
