The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986. The facts as alleged in the complaint are that he has purchased one
EM-500LExide battery under warranty for three years. The said battery did not function properly as a result he approached OP for replacement but despite repeated calls being made by complainant needful was not done by the OP. The complainant has suffered a lot due to the defective Jug battery. When he
made complaint to op on 26.02.2018 it was revealed that battery sold to complainant was a defective . Since the battery was not replaced he also lodged FIR against OP, therefore, he approached this Forum for redressal of his grievances.
Notice of the complaint was sent to OP on 29.05.2018. Counsel for OP appeared and stated that OP shall repair the battery within one week and on 06.07.2018 the Counsel undertook to replace the battery within one week.
On 13.07.2018 complainant appeared before the fora and submitted that yesterday night OP replaced the service battery with new one and that he was fully satisfied with the new battery installed by OP but submitted that he should be reasonably compensated for inconvenience suffered by him due to non availability of service battery since filing of he complaint till 09.06.2018 when the service battery was installed by the OP.
The complaint was instituted in this Fora on 23.03.2018 and the service battery as admitted by complainant was installed by OP on 09.06.2018 and new battery was replaced on 12.07.2018. The record indicates that complainant remained without service battery for about three months for which he needs to be compensated. We are of the opinion that to meet the ends of the justice it would be appropriate to compensate the complainant by awarding an amount of Rs. 2,000/-
