ORDER

1.      We have heard the learned counsel for the complainant.  His grievance is, complainant had purchased food articles from OP on 7.3.2019 after payment of Rs.349.04. It is his own case, MRP of the said products is Rs.349.04 which is inclusive of all taxes etc.  If it is the case, then admittedly OP had not overcharged any amount beyond MRP from the complainant.  Hence, it does not amount to unfair trade practice.
2.      The second grievance of the complainant is, in the invoice (Annexure C-1) issued on 7.3.2019 for Rs.349.04, an amount of Rs.11.42 was charged for carry bag which was supposed to be supplied free by the OP.  Food items were purchased and perusal of Annexure C-1 shows no item of carry bag is mentioned there for which Rs.11.42 was charged.  There is a reference of one 33 cm x 30.5 cm paper and it cannot be said to be a carry bag.  It is not the case of the complainant, the said paper was not utilized by him. There is no mention of carry bag.  If, in fact, it was a carry bag, same could have been produced by the complainant for inspection by this Forum to know of OP had practiced unfair trade practice by charging for the carry bag.  Paper if utilized then it cannot be, there is any unfair trade practice as it cannot be construed to be a carry bag.  There is no clarification in the consumer complaint.  Prima facie we do not find any case of deficiency in service or unfair trade practice on the part of the OP. Accordingly, we proceed to dismiss the consumer complaint, at preliminary stage.
3.      The certified copies of this order be sent to the complainant free of charge. The file be consigned.
