ORDER

Present :  Sh.Karamwant Singh, complainant in person

                  Opposite parties No.1 & 2 ex-parte

                  Sh.Ajay Shanker, Adv.counsel for the opposite party No.3

            Sh.Ajay Shanker, Adv.counsel for the opposite party No.3 suffered statement that opposite party No.3 is ready to refund 60% of the price value of the mobile hand set in question or replace the mobile hand set with a new mobile handset within 30 days from today subject to return of the mobile set in dispute, original bill, job sheet and accessories in possession of the complainant to the service centre.  

            The mobile handset was purchased by the complainant vide bill No.366 dated 22.10.2016  from opposite party No.1 for an amount of Rs.7000/-. Opposite party No.3 has offered 60% refund of full price of the mobile handset in dispute or replace the mobile hand set with a new mobile handset to settle the claim of the complainant.

As such, present complaint is allowed with a direction to the opposite party No.3 to  refund 60% of the price/value of the mobile hand set in question  within 30 days from the date of receipt of copy of order. The complainant is directed to return the hand set in dispute, original bill, job sheet and other accessories, if any, in his possession pertaining to the mobile set in dispute to the service centre of the opposite party No.3 within 15 days from today. The opposite parties are directed to comply with the order within 30 days of the receipt of copy of order, failing which, awarded amount shall carry interest at the rate of 6% p.a.from the date of receipt of copy of passing of order till payment is made to the complainant. Copy of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
