Heard.  The subject matter of the question under discussion is subsidy.  The grievances of the complainant is that he was not given the declared subsidy and thereby sustained loss of Rs.35,000/-.  It is a plain fact that the complainant neither purchased any goods nor availed any service from opposite parties for a consideration.  No payment is made by the complainant to opposite parties as far as present complaint in hand is concerned.  Thus the complainant cannot be considered as a consumer.  Under Section 2(d) of C.P.A. a consumer means any person who buys any goods for consideration or avails service for a consideration.  Even if he is entitled for subsidy he can not be claimed as a consumer.

         Since the complainant is not a consumer the complaint is not maintainable.  It is therefore the complaint in hands stands dismissed and it is not maintainable since the complainant is not a consumer.  Complaint dismissed.
