KERALA STATE CONSUMER DISPUTES REDRESSAL COMMISSION VAZHUTHACADU THIRUVANANTHAPURAM APPEAL:363/2008 JUDGMENT DATED.29..7..2009 PRESENT JUSTICE SHRI.K.R.UDAYABHANU : PRESIDENT SRI.M.K. ABDULLA SONA : MEMBER 1.Secretary, KSEB, Vydhudhi Bhavan, Pattom, Thiruvananthapuram. : APPELLANTS 2.Assistant Engineer, KSEB, Electrical Major Section, Painavu, Idukki Colony.P.O, Vazhathoppu, Idukki. (By Adv: Sri.S.Balachandran) V. 1.Joseph Devasia, Kunnumpurathu house, Thankamony.P.O, Idukki. : RESPONDENTS 2.Mathew Joseph, Aranjanal House, Thankamony.P.O, Idukki Dist. JUDGMENT JUSTICE SHRI.K.R. UDAYABHANU : PRESIDENT The appellant is the opposite party/KSEB in CC.18/2008 in the file of CDRF, Idukki. The appellant is under orders to fix a transformer for increasing the voltage in the electric connection of the complainants within 3 months and also to pay Rs.2000/- towards cost. 2. The case of the complainants is that they are consumers of the opposite party and that the opposite party had agreed to supply 250 watts of electricity to the complainants. But every day in the evening from 6pm to 10pm the voltage is very low. The children are unable to study for want of sufficient voltage. Spot bills are issued and the complainants are remitting the electric charges regularly. Despite repeated representations the opposite party have not taken any steps to increase the voltage. 3. It is the contention of the appellant that the matter is not restricted to the houses of the complainants but to the whole people residing in the area. Only on installing a transformer the condition can be improved. Because of the increasing population opposite party is not able to supply electricity with enough voltage. The alleged deficiency is denied. The evidence consisted of the testimony of PW1, Exts.P1 series, P2 and R1 series. 4. The complainants have produced copies of the petitions submitted before the appellants in this regard. Appellants have also produced Ext.R1 series with respect to the steps taken to install the transformer. The Forum has rejected the request of the complainants for give direction for reducing electricity bill. All the same the opposite party was ordered to install a transformer within 3 months. 5. We find that there is no illegality in the order. An year is over since the date of the judgment. It is hard to believe that the opposite arties are unable to install the transformer which is required in the situation. The consumers are charged for the electricity supplied. The opposite parties are bound to supply electricity with sufficient voltage. In the circumstances we find that there is no scope for admitting the appeal. The appeal is dismissed in-limine. Office will forward the copy of this order to the Forum. JUSTICE K.R.UDAYABHANU: PRESIDENT M.K. ABDULLA SONA: MEMBER VL.
