1)The complaint is allowed.

2)Opposite Parties are directed to deliver legal and physical possession of Flat T-1 on the 3^rd Floor of Building B in ‘Ratnadeep Apartment’, (or its alternative name, if any) in Curti, Ponda to Complainant.

3)In case Opposite Parties can show that construction of the above particular flat has been stayed/ prohibited by an order by a Court/Competent authority, they shall deliver an alternate flat, acceptable to Complainant, in the same complex of buildings.

4)The rate for such alternate flat shall be calculated @ Rs.2,800/- per square metre, being the same rate as per the suit Agreement between Complainant and Opposite Party-2.

5)Complainant is awarded compensation for delay of Rs.25,000/- and costs of Rs.10,000/-.

6)After receipt of possession of flat and against execution of conveyance thereof, Complainant shall pay the balance due (over and above Rs.94,000/- already paid), to Opposite Parties.

7)Both Opposite Parties are jointly and severally liable to comply with above directions and shall do so within 60 days of date of this order.
