ORDER

SRI. P. V. JAYARAJAN:  PRESIDENT

This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration.  After hearing the matter this Commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service and unfair trade practice on the part of the opposite party.  After admitting the complaint, notice was issued to the opposite party.  The said notice was served on the opposite party on 05.01.2024.  Subsequently the complainant submitted that the address of the opposite party was wrongly mentioned in the complaint and hence filed an application as I.A. No. 220/2024 to amend the address of the opposite party and the same was allowed on 12.06.2024.  Subsequently this Commission issued notice in the new address of the opposite party to appear before this Commission today.  When the case came up for consideration today, the complainant filed a memo stating that the dispute between the complainant and the opposite party is amicably settled out of court and the complainant is not willing to further proceed with this complaint.  The memo filed by the complainant is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.

In the result, the complaint is dismissed as settled.  There will be no order as to cost.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.

Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the Open Court, this the 8th day of August 2024.
