JUDGMENT
JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT
 
          The appellant is the complainant in CC.136/07 in the file of CDRF, Kollam. The complaint stands dismissed for default.
          2. The matter relates to compensation claimed with respect to the construction of the building. The opposite party had appeared when the matter was posted for evidence. The appellant has mentioned the reasons for the nonappearance of the concerned counsel   although another counsel had represented which is reflected in the order.
          3. In the circumstances, we find that a considered order is required. The order of the Forum is set aside on condition that appellant remit a sum of Rs.2500/- towards costs of the opposite party. The amount can be withdrawn by the complainant.   On deposit of the amount   the Forum will permit the parties to adduce the evidence and dispose of the matter on merits. The case will stand posted before the Forum on 17/6/2009.
          Office is directed to dispatch this order to the Forum urgently.
