: J U D G M E N T :
This case has arisen out of the complainant, Ranjit Mitra filed on 01.04.13 on the ground that on 27.03.12, the complainant was attacked with chicken pox and was admitted on 02.04.12 at 8.00 pm to Nadia District Hospital, under Dr. Kumud Ranjan Biswas. Dr. Biswas released him on 08.04.12.
The applicant is a very poor man belonged under BPL with list No. WB-13-009-007-012/37264. He spent Rs. 16,289/- for his treatment as such buying medicines hiring vehicle, diagnostic test etc.
The Governor’s Office received the copy of the complaint along with the annexures on 10.04.13 and replied to the letter of the complainant vide No. 1858-G, dated 26.04.13.

- Is the complainant a consumer?
- Is the complainant entitled to get any relief / award of Rs. 16,289/-.
REASOND DECISIONS
For the sake of brevity and convenience both the issues are taken up together for discussion.
From the written version of Governor’s Secretariat, Raj Bhavan, it is clear that the financial assistance was not provided as the said assistance was prayed after one month from the date of release. The date of release from the Hospital was 08.04.12 and the date of prayer for financial assistance was 14.05.12. The Assistant Secretary, to the Government of West Bengal has categorically pointed out that no financial assistance could be provided after the discharge of the patient from the Hospital. Hence, no cheque for financial assistance could be given to the applicant. It has been also pointed out by the Government of West Bengal that after discharge the Hospital does not accept any cheque for the patient. Moreover, it has been indicated by the Government of West Bengal that there was no estimated cost enclosed with the prayer or application to the Governor.
Unless there is an estimated cost furnished the question providing financial assistant could not be considered.

No original document is forthcoming to establish the case of the complainant. Moreover, the OPs are living beyond the jurisdiction of Nadia District. So, both the points are disposed of in the negative.
Hence,
Ordered,
That, the case CC/13/26 be and the same is dismissed on contest. No cost.
Let a copy of this judgment be delivered to the parties free of cost.
