The appellants are the opposite parties in CC.202/2010 in the file of CDFR, Idukki.  The appellants are under orders to pay a sum of Rs.14,110/- as compensation and cost of Rs.2000/-.

2.      The matter is with respect to the alleged deficiency in not providing the promised discount.  The opposite parties were exparte.  It is submitted by the counsel for the appellant that the concerned lawyer omitted to note the posting date and hence opposite parties happened to be exparte.

3.      In the circumstances the order of the Forum is set aside on condition that the appellants/opposite parties pay a sum of Rs.5000/- towards cost to the complainant or deposit the same before the Forum which can be withdrawn by the complainant.  On payment of cost the Forum will permit the opposite parties to file version and contest the matter and dispose of the case on merits.

The Forum will issue notice to the complainant.  The case stands posted before the Forum on 5/4/2011.

Office will forward copy of this order to the Forum.
