Sh. Ashwani Kumar, Adv.-D.H. in person has stated that he had purchased a refrigerator from JD-respondent No.3 i.e. M/s. Bhawani Enterprises Opposite Khurania Filling Station, Dhand Road, Kaithal and it was very defective and complaint was made to JD-respondent No.3 that the refrigerator is defective. It has been stated by Sh. Ashwani Kumar that water comes out from the refrigerator and on complaint, from the company i.e. respondent No.3 has sent a mechanic but as per observation of mechanic, refrigerator was totally damaged and the problem in the refrigerator was still existing. Hence, in execution, he has requested for replacement/refund of the cost of refrigerator.
Heard. Sh. Vikram Tiwari, Adv. for the JDs-respondents No.1 & 2 has stated that a mechanic was sent for repairing of refrigerator but it is not ascertained that the refrigerator is working or not.
Since the refrigerator is defective and not working. Hence, the JDs-respondents are hereby directed to refund the amount of bill of refrigerator to the D.H.-Ashwani Kumar within two months from today alongwith interest @ 6% p.a. In default, the JDs-respondents shall be liable to pay penal interest @ 9% p.a. Hence, the present execution is hereby disposed of. Copy of this order be sent to the parties free of cost. File be consigned to record after due compliance.
