Counsel for the petitioner does not dispute that the patient admitted in its hospital fell from the dressing table having height of 4½ feet, as a result of which the patient had bleeding injuries from nose, left knee and toe of the left leg.

          The State Commission has quashed the medical bill of Rs.36,007/- raised by the petitioner towards expenses for treating the patient, who later on died, and in addition has directed the petitioner to pay the sum of Rs.35,000/- by way of compensation along with interest at the rate of 9%. 

The only submission made by the counsel for the petitioner is that there was no causal link between the even of falling down and the subsequent death of the patient.  According to him the patient died because of Septic Arthritis.  The very fact that the patient fell from the dressing table having a height of 4½ feet shows the negligence on the part of the petitioner.

We agree with the view taken by the State Commission.  Dismissed.
