This revision petition has been filed by the revision petitioner/Opposite Party, against the order dated 30.01.2019 passed by District Consumer Disputes Redressal Forum-I, U.T., Chandigarh (in short ‘the Forum’) vide which, for not putting in appearance on the date fixed, exparte proceedings were ordered to be taken up against the revision petitioner/Opposite Party. 4. At the time of arguments, Sh.Joginder Singh, respondent/complainant states that he has no objection in case the order under challenge is set aside and liberty is granted to the revision petitioner/Opposite Party to place on record its reply and evidence/affidavit and the matter be decided on merits. 5. Counsel for the revision petitioner/Opposite Party states that reply and evidence/affidavit is ready and it will be filed on the very first date of appearance before the Forum. 6. Accordingly, the revision petition is allowed. Order dated 30.01.2019, under challenge, is set aside. 7. Parties are directed to appear before the Forum concerned on 14.06.2019. 8. On the said date, as per undertaking given, reply and evidence/affidavit be filed by the revision petitioner/Opposite Party on the very first date of appearance before the Forum. 9. We make it very clear that in case, reply and evidence/affidavit is not filed on the next date of hearing, no further opportunity shall be granted for the said purpose. 10. Order passed is subject to payment of cost of Rs.5,000/- by the revision petitioner/Opposite Party to the respondent/complainant, before the Forum on the date fixed. 11. Complete record of complaint file be sent back to the Forum concerned alongwith certified copy of this order, so as to reach there before the date fixed. 12. Certified copies of this order be sent to the parties, free of charge. 13. File be consigned to the Record Room after completion. |
