Shri R. K. Lokhande, learned counsel for petitioner.
Shri Sandeep Guru, learned counsel for the respondent/complainant.

2. This revision is directed against the order dated 04.02.2019 passed by the District Consumer Disputes Redressal Forum, Bhopal (For short the ‘Forum’) in C.C.No.730/2018 by which the District Forum has proceeded ex-parte against the opposite party no.1/petitioner as they failed to appear within 30 days and to file reply before the Forum.
3. Learned counsel for petitioner submits that the Law Officer of the petitioner was on leave and as such he could not appoint Advocate, who could have filed reply.
4. Having considered the submissions made by the learned counsel for petitioner as also the respondent/complainant we are of the view that there was sufficient cause for non-appearance of the petitioner before the Forum on the date fixed. In the circumstances by condoning the absence of the petitioner, we set-aside the impugned order and direct the Forum to grant opportunity to petitioner to file reply however, subject to payment of cost of Rs.500/- in each case payable to complainant by the petitioner on or before the next date of hearing. Parties are directed to appear before the Forum on 29.05.2019. The Forum thereafter shall proceed further in accordance with law.
5. This revision petition is disposed of. This order be placed in Revision Petition No.45/2019 and a copy be placed in Revision Petition Nos. 46 to 49 OF 2019.
