Sh. Pankaj Raturi, learned counsel for respondent No. 1 and Sh. Jitender Pal Singh – respondent No. 1 in person, are present. There is none to represent the appellant and respondent Nos. 2 & 3.
Heard on the application dated 23.04.2019 bearing Paper No. 55 moved by respondent No. 1, whereby the respondent No. 1 has requested for receipt of demand draft amounting to Rs. 4,49,640/- (Rupees Four Lacs Forty Nine Thousand Six Hundred Forty Only), furnished by respondent No. 2.
Perusal of the record reveals that in respect thereof, order was passed on 16.04.2019 for correcting the array of parties.
In the original record, the amendment has already been done in compliance of the order passed by this Commission.
Considered. In the interest of justice, the application moved by respondent No. 1 is allowed.
The demand draft in question be handed over to Sh. Jitender Pal Singh – respondent No. 1. The photocopy of the demand draft be kept on record.
The appellant did not turn up.
On 23.04.2019, specific order was passed to the effect that in case the appellant does not turn up on the next date fixed, appropriate order would be passed in the absence of the appellant.
As none is present on behalf of the appellant to press the appeal, therefore, the appeal is dismissed for want of prosecution. Let the matter be consigned to record room.
