The matter is heard ex-parte.
The brief dispute raised in this consumer complaint is that the complainant installed a Jio Fibre Connection on 25.09.2022 and paid Rs.4,240.92 (Rupees four thousand two hundred forty point ninety two) only towards installation and advance payment of monthly bill for six months. The service of the connection was stopped suddenly without any intimation from 27.08.2023 to 30.08.2023. At the time of installation the opposite party no.4 committed to the complainant that the connection was a prepaid one and the service would be stopped and resumed back at any point of time as per complainant’s convenience. To his utter surprise, when he contacted the Jio Fibre Customer Care regarding the stoppage of service on 27.08.2023; he was told that the connection was a post paid one and the same could not be stopped and resumed back as per complainant’s convenience.
We have heard the submission made by the Ld. Advocate for the complainant and perused the records. On perusal of the same it is observed that the Reliance Jio Infocom Ltd. has not been made a party in this case, only their local manager and three individuals purported to the sales representative have been made parties.
Therefore, the instant consumer complaint suffers from non-joinder of the necessary party. Moreover, in the relief Sl. No. (i) the complainant has prayed for a direction upon the opposite parties to refund the course fees of Rs.706.82 to the complainant. This relief as sought for by the complainant has no merit as he never claimed that he paid any course fees to any of the opposite parties.
Therefore, the relief as prayed by the complainant also has no merit.
Hence, it is
O R D E R E D
that the complaint case be and the same is dismissed without cost.
