CC No.168 of 2019.

Paramjeet Kaur Versus Jindal Realty.

 

Present:       None for the complainant.

                   Shri Sahil Mangla, Advocate for the OPs.

                                     

                   Today, the case was fixed for appearance of complainant. However, case has been called several times since morning, but complainant failed to appear before the Commission, either, in person or through any advocate up to 03:30 PM. Further wait is unjustified. History of the proceedings shows, earlier on 12.04.2021, written statement filed by the OPs and the proceedings were adjourned to 07.07.2021 for evidence of complainant. On 07.07.2021, no evidence adduced on behalf of complainant and on the request of counsel for the complainant, proceedings were adjourned to 13.10.2021 for the same purpose. On 13.10.2021, again adjournment prayed by counsel for the complainant and case was adjourned to 16.12.2021 for evidence of complainant subject to last opportunity. On 16.12.2021, Members of Bar have suspended the work and proceedings were adjourned to 21.02.2022 for the purpose already fixed. On 21.02.2022, again evidence of complainant was not ready and adjournment prayed by his counsel, which was allowed and proceedings were adjourned to 14.03.2022 for evidence of complainant with last opportunity, subject to the payment of Rs.100/- as cost, to be deposited in the Government Head-0435. However, on 14.03.2022, neither the complainant appeared nor cost was deposited nor any evidence was adduced on his behalf and case was adjourned to 29.03.2022 for appearance of complainant. Again on 29.03.2022, the position was the same and proceedings were adjourned to 02.04.2022 for the purpose already fixed, but on 02.04.2022, there was a holiday and file taken up on 04.04.2022 and proceedings were adjourned to 18.04.2022 i.e. for today for appearance of complainant, but even on today, neither the complainant nor his counsel appeared nor any evidence adduced on his behalf. Non-appearance of complainant on today as well as on the last two effective dates of hearing i.e. on 14.03.2022 and 29.03.2022, means, complainant is no more interested in pursuing the present complaint, therefore, the present complaint is hereby dismissed for want of prosecution. However, in the interest of natural justice, permission is granted to the complainant to file afresh complaint, if he so desires or advised. Certified copy of this order be supply to the parties concerned, as per rules and file be consigned to the records, after due compliance.
