Pleadings of the complainant in brief.
1. The complainant gave his Honda Unicorn motor cycle bearing register number KL49J-5910
to the Opposite Parties for repair /servicing under AMC arrangement and it was booked as job
card number V-17479.
At the time of handing over, the complainant explained all the problems of the vehicle such
as low mileage, sound variation of the silencer, low power of the engine etc to the service
advisor and were recorded in the service slip.
Though the opposite party charged Rs. 1243/-, as service charges, the repair/servicing was
not properly done by them. Again, the vehicle was entrusted to the opposite parties on
11/02/2020, but they returned the vehicle after doing only water servicing and charged for all
the works excluding the items covered under AMC. When enquired again about the
unrectified complaints /defects of the vehicle, the opposite parties insulted the complainant
instead of attending to his genuine demands.
His prayer is for a compensation of Rs. 10562/-towards the repair charges,
mental agony and loss of wages.
2. Notices were issued to the opposite parties and they entered appearance and filed
their version on 28/01/2021.Their contentions are summarized as follows.
A. They had attended all the complaints of the vehicle as per the job card before
delivering it to the complainant after servicing on 25/01/2020.
B. On 11/02/2020 also, they had undertaken all the works as per the job card
and charged only for the parts replacement of parts those were damaged due
to the rough use of the vehicle by the complainant.
C. On both the above occasions, the complainant had taken delivery of the
vehicle after getting satisfied with the repair /servicing.
D. They never insulted the complainant, instead tried to explain the things to the
complainant.
3. Both the complainant and the opposite parties were very irregular in attending
the proceedings of the case. They never submitted proof affidavit or marked any
document in support of their arguments.
4. In the result, the Commission is not in a position to draw any conclusion as to the merits of
the pleadings raised by the complainant and it is only liable to be dismissed.
Hence the complaint is dismissed.
