It is seen from the copy of the order of the Forum that appellant was set exparte by the Forum. Taking into account, the nature of the contentions raised by the parties, we feel that an opportunity should be given to the appellant to contest the matter on merits. The appellant has to pay cost of Rs.5000/- to the complainant.

In the result, the order of the Forum allowing the complaint is set aside. The matter is remanded to the Forum for fresh disposal in accordance with Law. Appellant shall appear before the Forum on 30.06.2017.On receipt of copy of the judgment, Forum shall issue notice to the complainant. Appellant is permitted to pay cost before the Forum.
