HON’BLE MR. JUSTICE MANOJIT MANDAL, PRESIDENT

  1. This is to consider an application under section 48 of the Consumer Protection Act, 2019 filed by the petitioners.
  1. Heard the Learned Advocate appearing for the petitioners. Perused.  Considered.
  1. Having heard the Learned Advocate appearing for the petitioners and on perusal of the record it appears to me that by this transfer application the petitioners are seeking transfer of case being No. EA/107/2023 arising out of complaint case No. CC/114/2021  from the Learned District Consumer Disputes Redressal Commission, Baruipur, South 24 Parganas (in short, ‘the District Commission’) to any other District Commission.
  1. Having considered the submission made by the petitioners and having gone through the reason stated in paragraph No. 2 of the transfer application, I find no justified ground to transfer of case being No. EA/107/2023 arising out of complaint case No. CC/114/2021 from the Learned District Commission, Baruipur to any other District Commission.
  1. In the circumstances, the prayer for transfer of case is rejected.
  1. It is made clear that if the petitioners are aggrieved by the order passed by the Learned District Commission, it will be open for them to challenge the same by way of appropriate legal proceedings, in accordance with law.
  1. The transfer application stands dismissed.
  1. The transfer application is, thus, disposed of accordingly.
