The appellant/opposite party in CC.165/10 in the file of CDRF, Thiruvananthapuram is under orders to refund a sum of Rs.5,50,000/-.
The appellant was exparte before the Forum.
In view of the fact that the order cannot be treated as a considered one the same is set aside on condition that the appellant/opposite party pay a sum of Rs.10,000/- to the complainant towards costs or remit before the Forum which can be withdrawn by the complainant. On payment of cost the Forum will permit the opposite parties to contest the matter and dispose of the case on merits. The case stands posted before the Forum on 28.2.2012.
