Both the parties are absent without any step. This particular case, which was earlier ‘Filed’ on 02.03.2021 and subsequently restored to proceeding on 01.10.2021 on the order upon a petition filed by the advocate of the complainant dated 25.08.2021 with direction to take steps of notice of restoration on the opposite parties. After repeated directions the complainant on 23.12.2021 took steps of notice of restoration of the case to the O.P. The complainant was asked to submit the postal track report concerning the notices sent to the O.P. vide order dated 03.02.2022 fixing 15.03.2022 for the same. But the complainant failed to submit the postal track report as directed for which he was again directed to take fresh step of notice on the O.P. But from that date no fresh step has been taken by the complainant till 24.03.2023. It was presumed that the complainant is not interested to proceed with the case further for which the complainant deliberately delayed the proceeding. On 24.03.2023 the complainant was finally directed to take step of notice within 7(seven) days from that day failing which the case will be dropped from proceeding on the next date fixed and the date was fixed on 11.05.2023. But the complainant had failed to avail the last and final opportunity of taking step and the case was fixed for necessary order on 26.06.2023. After consulting with both the Members this Commission has come to the conclusion that further proceeding in this case will be of no use except misuse of manpower and valuable time of the Commission. Hence, the case is dropped from proceeding finally.
