Mandeep Kajal Vs. Jeeves Consumer

 

Present:     None for decree holder.

               

                Today the case is fixed for show cause notice to JD. Show cause notice to JD could not be issued due to non filing of registered cover etc. Case called several times since morning but none has appeared on behalf of decree holder. It is already 12:30 PM. No further wait seems to be justified. From perusal of order sheets, it is clear that the case was fixed for notice to JD after filing registered cover by decree holder w.e.f. 12.05.2021 but show cause notice to JD could not be issued and registered cover also not filed till today. Despite availing seventeen opportunities by the decree holder, which means that the decree holder is not interested to proceed the present execution petition further thus, present execution petition is hereby dismissed for want of prosecution. However, the decree holder is at liberty to file the fresh execution petition. Copy of the order be sent to decree holder free of cost. File be consigned to the record-room after do compliance.
