J u d g e m e n t.
1.The present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non revision of Electrical bill vide consumer No. 313101220158.
2.Upon Notice, the O.Ps filed written version through their legal officer in which they refuting allegation made against them. The O.Ps taking one and another pleas in the written version sought to dismiss the complaint as it is not maintainable under the C.P. Act, 1986. The facts which are not specifically admitted may be treated as denial of the O.Ps . Hence the O.Ps prays the forum to dismiss the case against them to meet the ends of justice.
Heard arguments from the learned counsels for both the parties. Perused the record, documents, written version filed by the parties.
This forum examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
3.Undisputedly the complainant is a Electrical consumer vide consumer No. 313101220158 and availed service of the O.Ps on payment of monthly electrical energy charges.
4.The main grievance of the complainant was that the O.Ps had sent bills in the month of April, 2014 a sum of Rs.9,667/- and in the month of February, 2017 a sum of Rs.31,595/- which was completely excessive . After receipt of the bills the complainant approached the O.Ps for revision of the bill, but the O.Ps are paid deaf ear and had not revised the above bill. Hence this C.C. case.
5.The O.Ps in their written version contended that on considering the grievances in the year 2014 and statement of billing during the period from September, 2013 to January, 2014 provisional billing was done.. As per the rule and regulation taking the average consumption for three months the bill has been revised and corrected in the month of March, 2014. Since the bill has been revised and effected in the monthly bill of the consumer after duly considering the allegation.
6.This forum observed after filing of the C.C. case the O.Ps have revised the electrical bill and there is no deficiency in service on the part of the O.Ps.
7.Hence to meet the ends of justice the following order is passed.
O R D E R
In resultant the complaint petition is allowed in part on contest.
The complainant is directed to deposit the revised bill in the counter of the O.Ps. Parties are left to bear their own cost.
The entire directions shall be carried out with in 30 days from the date of receipt of this order.
