BY THE STATE COMMISSION ( PER HON'BLE MRS. JUSTICE NISHA GUPTA,PRESIDENT):

 

The appeal has been listed on application u/s 5 of the Limitation Act. Admittedly the District Forum has passed the judgment on 25.2.2015 and appeal has been filed with a delay of 213 days.

 

The contention of the appellant is that new office has been opened for the concerned area and hence delay has been occasioned but no reason has been assigned about the fact that when new office was started and why delay has been occasioned to file the appeal. Furthermore in application itself it has been narrated that on April 2015 the new office has been opened and admittedly till then the limitation for filing of the appeal was passed away. Hence, nothing has been explained that why delay has been occasioned to file the appeal and that too of 213 days.

 

Hence, there is no reason to allow this application. This application is dismissed as well as the appeal.
