ORDER

Learned Counsel for the Petitioner submitted that he has filed this Revision Petition against the Order of the West Bengal State Consumer Disputes Redressal Commission (for short ‘State Commission’) dated 25.03.2019 which dismissed his Appeal on account of non-prosecution.  He submitted that he has a strong case against the Order of the Purba Medinipur District Consumer Disputes Redressal Commission’s Order dated 23.04.2018 and that he may be given an opportunity to argue on merits before the State Commission.  From the record, it is seen that the Petitioner/Appellant did not appear on the previous hearing date also.  The absence of the Counsel was not intentional.  There were only three hearings done and the Counsel was not present on two hearings on account of unavoidable reasons.

          Heard the arguments of the learned Counsel for the Petitioner and perused the record.

          We are of the considered opinion that the matter needs to be heard on merits and accordingly, we remand this Revision Petition to the State Commission, which shall hear the Appeal filed by the Petitioner/Appellant on merits subject to a cost of Rs.10,000/- to be deposited in the legal aid fund A/c of the State Commission and Rs.30,000/- to be paid to the Respondent/Complainant for her sundry and to & fro travel expenses within four weeks of this Order.

          The Order of the State Commission dated 25.03.2019 is set aside.

          Parties to appear before the State Commission on 20.12.2024.

          The Revision Petition is accordingly disposed of.
