ORDER

Learned counsel for the petitioner states that parties have arrived at an amicable settlement pertaining to this matter as well as other litigations pending between them in respect of subject matter of dispute. He has tendered the memorandum of settlement duly signed by the authorized representative of the petitioner Bank and the respondent containing the terms and conditions of the settlement. Learned counsel for the petitioner on instructions and the respondent submit that they have voluntarily arrived at the settlement and they shall abide by the terms and conditions of the settlement. Pursuant to that settlement a cheque of Rs.3,00,000/- (rupees three lacs only) bearing No.415663 dated 21.11.2014 drawn on ICICI Bank Ltd. in favour of the respondent has been tendered to him in full and final settlement of his subject claim. Respondent has accepted the cheque subject to encashment in full and final settlement between the parties as recorded in the terms of settlement filed today. In view of the above, learned counsel for the petitioner seeks to withdraw the revision petition.

Revision petition is dismissed as withdrawn. Parties shall be bound by the terms and conditions of the settlement.

The petitioner has deposited 50% of the award amount with the District Forum concerned pursuant to the order dated 27.3.2014 as a pre-condition to the  stay of the execution of the impugned order. District Forum is directed to release that amount to the petitioner with interest accrued, if any.
