JUDGMENT

 

JUSTICE SRI.K.R.UDAYABHANU  : PRESIDENT

 

 

          The appellant is the 1st opposite party in CC.15/05 in the file of CDRF, Alappuzha.  The appellant is under orders to pay a sum of Rs.5000/- as compensation and  Rs.3/- the balance amount and Rs.1000/- towards cost.

          2. The matter related to the alleged deficiency in service on the part of the opposite parties.

          3. The evidence adduced consisted of the testimony of PW1 and PW2 and RWs 1 to 3; Exts. B1 to B4.

          4. We find that there is no reason in support of the findings of the Forum.  The evidence has not been considered at all.  The Forum ought to have considered the evidence adduced by both sides and arrived at a finding.   Subjective satisfaction is not envisaged when quasi judicial orders are issued.  Passing such orders amounts to disservice to the consumers.  The order of the Forum is set aside.  The Forum is directed to dispose of the matter afresh after hearing both sides.

          5. The case stands posted before the Forum on 23.9.2010.

          Office will forward the LCR along with the copy of this order to the Forum urgently.
