Mr. Munish Kumar Garg, Adv. along with Ms. Bhawna Thakur, Adv. for appellants.

                   There is a delay of 14 days in filing of this appeal and to condone the same; an application (M.A. No. 254 of 2024has been filed, which is supported by an affidavit. Application stands allowed for the reasons mentioned therein and delay of 14 days in filing of this appeal stands condoned. Accordingly, application stands disposed off.  

                   Present appeal has been preferred against order dated 09.02.2024 passed by District Consumer Commission-Kurukshetra, vide which complainant’s complaint was allowed. Along with appeal application (M.A. No. 255 of 2024for interim relief/stay has also been filed. While urging for interim relief/stay learned counsel for the appellants has urged that: a specific defence has been taken by appellant in their written version submitted before learned District Consumer Commission-Kurukshetra that no notice was served to appellants to reach at spot at the time of inspection by team of Horticulture Department, which is contrary to Govt. instructions dated 03.01.2002 which has been appended along with this appeal as Annexure-A-12. Inspection report is appended along with this appeal as Annexure-A-6. On prima-facie perusal of same, it is visible that it does not signature, either of manufacturer of seed (appellant herein) or its authorized dealer-M/s Aggarwal Seeds Store (OP No.1). This contention, prima-facie carries credence. This being so, implementation of impugned order dated 09.02.2024 would remain stayed during pendency of this appeal. As per office report, Rs.86,512.50/- has been deposited by appellant, being the statutory amount required to be deposited while filing instant appeal. This amount would keep lying here during pendency of this appeal. Application for interim relief/stay (M.A. No. 255 of 2024stands disposed off in above terms. Notice of main appeal as well as on application of additional evidence, be issued to respondents for 20.01.2025 through registered post.

                   Dasti (by hand) may be issued, if, so, desired.
