    Complainant who is in person present.   Advocate for Op No.2 and 3 is present.   The advocate for Op No.2 and 3 on 10/11/2010 submitted to this forum that they are prepared to replace old laptop with a brand new one.   In continuation of it, the matter is taken up today for reporting settlement.   While hearing the matter, the counsel for Op No.2 and 3 submitted that they are even prepared to refund cost of the laptop if the complainant so desire.  Complainant is agreeable for receiving the cost of the laptop which is Rs.38,000/- claimed in the complaint.   Counsel for the Ops is not disputing the cost of the laptop.   Complainant admitted to had used the laptop without any problem for more than 2 years.   Considering these aspects, we proposed to direct the Op No. 2 and 3 to refund the cost of the Laptop and direct the parties to bear their own cost for which, both parties are agreeable.   Hence, we pass the following order.

 

O R D E R

 

          Complaint is allowed.   Op No.2 and 3 are jointly and severally held and directed to refund Rs.38,000/- to the complainant within 30 days from today.  Failing which, they shall pay interest @ 12% p.a from today till the date of payment.

 

         Ops shall pay that amount through cheque or DD to the complainant to his Jaipur address as he is now working in Jaipur.

 

         Parties to bear their own cost.
