Respective parties are present. Both of them submit that the O.P had received a sum of Rs.42,000/-(Forty two thousand)only from the complainant to provide has with a second hand vehicle which the O.P could not provide,since the complainant had borrowed the money with hand interact, she has claimed the rupees one lakh which is inclusive of the principal and interest. However taking into consideration the health hazards of the O.P. The complainant agreed to immediately received the principal amount of Rs.42,000/- payable in nine istallments of Rs.5000/-each in every month for 8 month and Rs.2000/- in the 9 month. They have accordingly filed a memo of settlement which form part of this order. The case is accordingly close and disposed of.
