Learned counsel for the appellant is present.

2.      The Senior Block Education Officer and A.D.E.O. are present on V.C.  Heard.

3.      The case of the complainant in nutshell is that the husband of the complainant was working as a teacher in Adanga Urdu Primary School and died on 22.6.1994. On several occasions, she approached the opposite party for death claim benefits under G.I.S. but she has not received any benefits. Thereafter, complaint was filed. Written version was also  filed.

4.      After hearing the parties, learned District Forum passed the following order:-

  “ In result the C.D. case is allowed with cost. The O.P.No.1 is directed to make arrangement for payment of dues payable to the petitioner towards death claim benefit under G.I.S. of Sk. Mobarak Ali with 5% interest and the O.P.No.1 is directed to pay Rs. 200/- towards litigation charges and compensation of Rs. 500/- to the petitioner for deficiency in service within one month of receipt of this order.”

5.      During hearing of the appeal, learned Standing Counsel for the appellant submitted that they have complied the order. In support of his submission, he filed the affidavit of Sr. Block Education Officer and A.D.E.O. who are present in the V.C. They also submitted that they have paid all the dues of the complainant.

6.      We have perused the same. Since the deficiency in service has been removed during the appeal, the impugned order passed by the learned District Forum is set aside.

7.      The appeal stands allowed. No cost.

          The presence of Sr. Block Education Officer and A.D.E.O. on V.C. is also dispensed with.

          DFR be sent back forthwith.
