By Smt. Padmini Sudheesh, President The case of the complainant is as follows: The complainant had joined in the 7th day Pooval kuri conducted by the respondent on 7th December 2000. The instalment amount was Rs.2500/-. The complainant paid the instalments promptly without any default up to 7/12/2006. On 18th instalment complainant had auctioned the kuri. After auction the complainant approached the kuri company for the auctioned kuri amount but they refused to give. So no payment made further. Consequently the complainant demanded the amount he had paid. But the respondent refused the payment. Hence the complaint for return of the paid amount. 2. The respondent is declared exparte. 3. To prove the case of the complainant he has filed affidavit and the document produced by him is marked as Exhibit P1. 4. According to the complainant he had paid 18 instalments of Rs.2500/- each. The kuri has 36 instalments. On 7th August 2006, the complainant had auctioned the said kuri. But the auctioned amount was refused. So this complaint is filed to get the remitted amount. There is no counter evidence to the evidence of the complainant. The document produced by complainant is the kuri pass book and is marked as Exhibit P1. The complaint is for getting the kuri amount he had paid for 18 instalments. By perusing the Exhibit P1 pass book it can be seen that the termination of the kuri is in the year 2012. So the complainant is not entitled to get the amount now. 5. In the result the complaint is dismissed being premature.
