ORDER

By Smt. Padmini Sudheesh, President: The petitioner is a minor girl and she is represented by her mother, the natural guardian. The petition and affidavit are filed by the mother Sheena Benny on behalf of the minor . As per the petition and the affidavit filed by the petitioner, the respondent was conducted kuri business and the minor petitioner was a subscriber of the 10th day quarterly kuri. Pass book is produced and marked as Ext. P1. The quarterly instalment is Rs.2500/- and for 30 instalments Rs.75,000/- is the amount and it is paid and recorded in the pass book. The last instalment made by the petitioner is on 10.5.05 and the total amount paid in the respondent institution is Rs.75,000/-. 2. The respondent stopped the business before completing the said kuri and on 10.4.06 Rs.20,000/- is returned to the petitioner by the respondent and it can be seen from Ext. P1 pass book. The balance amount is not returned to the petitioner. So on 30.4.07 lawyer notice was sent to the respondent and was received, but no reply. Hence the petition. 3. The notice issued to the respondent from the forum is accepted by the respondent, on 29.5.07 and not appeared before the Forum. On 19.7.07, when the case was called, the respondent was absent and set exparte. He is deliberately avoided the notice from the Forum. 4. To prove the case of the petitioner she has filed affidavit and four documents. The documents are marked as Exts. P1 to P4. 5. Heard the Counsel. 6. According to the petitioner, she is entitled to get the balance amount of Rs.55,000/- and 12% interest from 10.5.05 till realisation. She also claims for mental agony and costs. 7. There is no counter evidence to the evidence of the petitioner. Sufficient time is got by the respondent to approach the Forum and furnish his version. The respondent is deliberately disobeying. So the petition is allowed and the respondent is directed to return to the petitioner Rs.55,000/- (Rupees fifty five thousand) and 12% interest from 10.5.05 and 6% interest from today till realisation. She is also entitled for Rs.1000/- (Rupees one thousand only) for mental agony and Rs.500/- (Rupees five hundred only) towards costs. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 28th day of March 2008.
