ORDER

By Smt. Padmini Sudheesh, President Petitioner’s case is as follows: The respondent Company was conducted Kuri business and petitioner was a subscriber of 10th day quarterly kuri. For 32 instalments she has paid Rs.80,000/- in total. The quarterly instalment was Rs.2,500/- and she has paid the instalment including 10/11/05. After that the respondent Company dropped its business and she is entitled for Rs.80,000/-. On 10/5/06 the Company returned to the petitioner Rs.25,000/- and on 17/8/06a Cheque is issued for another Rs.25,000/- in the name of the husband of the petitioner. But the cheque is dishonoured and returned as funds insufficient and criminal case is pending against the Co. and its directors. A lawyer notice dated 3/3/07 is sent by demanding the amount. The notice is accepted but no reply and no money. Hence this petition. 2. The notice from the Forum is accepted on behalf of the respondent on 24/5/07 and when the case was called on 12/7/07 he remained absent and declared exparte. 3. To prove the case of the petitioner she has filed Affidavit and 4 documents. The documents are marked as Exts. P1 to P4. 4. According to the petitioner, she is entitled to get back from the respondent Rs.55,000/- and interest. She also claim compensation and costs. There is no counter evidence to the evidence of the petitioner. 5. I n the result the petition is allowed and the respondent Company is directed to return the petitioner the amount of Rs.55,000/- (Rupees Fifty five thousand only) with 12% interest from 10/5/06 and 6% interest from today. No order as to cost and compensation. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open forum this the 5th day of May 2008
