The case is placed before this Lok Adalat as per order No.7 dated 9.3.2015. On call both the parties are found present. On discussion both the parties have admitted that they have settled the matter and the Jdr. has filed a bankers cheque for Rs.7,732/- being No.404769 dated 7.3.2015 drawn on Vijaya Bank. The Dhr. has admitted before this Lok Adalat that he is satisfied and the impugned final order will be satisfied, if the cheque as mentioned above is handed over to him.
So, there is no bar to dispose of the case on full satisfaction.
Hence, it is
ORDERED
that the execution case being No.58/2014 is disposed of on full satisfaction.
The Dhr. Nilanjan Chakraborty has filed photocopy of his identity along with original. The photocopy is compared with the original. The Ld. Advocate for the Jdr. has not challenged the identity of the Dhr. Nilanjan Chakraborty. We are of the opinion that Nilanjan Chakraborty himself is present. So, there is no bar to hand over the bankers cheque to the Dhr. Nilanjan Chakraborty on proper receipt.
Let the bankers cheque as mentioned above be handed over to the Dhr. Nilanjan Chakraborty for encashment on proper receipt.
The Dhr. Nilanjan Chakraborty files receipt showing that he has received the bankers cheque as mentioned above. Let the same be kept with the record.
Let the copies of this order be supplied to the parties free of cost and the case record be returned to the forum from which it is received.
