Rajni Rani Versus JIT

Present:- Smt.Rajni Rani, DH along with Counsel Sh.V.K.Singla, Advocate.

Parties have entered into compromise. Today Statement of Smt.Rajni Rani, DH along with Counsel Sh.V.K.Singla, Advocate recorded that she has compromised the matter with the JD in terms of the agreement-cum-compromise dated 10.08.2021 entered into with the JD and Smt. Meena Kumari, wife of Sh.Ashwani Kumar, which is being produced today before this Commission as Ex.C-1 which bears her Signatures and Signatures of Chairman, Jalandhar Improvement Trust and Smt.Meena Kumari. As such, she does not want to proceed with the present execution application and same may kindly be dismissed as withdrawn being fully satisfied. The Parties be made to remain bound by the said agreement is Ex.C-1.

Further Statement of Sh.Ashwani Kumar son of Sh.Rattan Chand resident of 633-B, Surya Enclave, Jalandhar recorded that he is husband of Smt.Meena Kumari, party to the agreement Ex.C-1, which he has seen in Original on record and the same bears Signatures of his wife Smt.Meena Kumari and the same is correct and duly entered into by the Parties to the said agreement. He is authorised by his wife to make this statement and the Authority Letter is Ex.C-2. He is also witness to the said agreement Ex.C-1 which was executed & signed by the parties to it in his presence. He has heard the statement of Smt.Rajni Rani given today before this Hon'ble Commission which is correct.

Statement of Sh.Pawan Kumar, Clerk of JIT/JD also recorded that he is working as Clerk with the JD/JIT and he has seen the Original agreement Ex.C-1 on record which bears Signatures of Chairman Sh.Daljeet Singh Ahluwalia on the same on behalf of the Jalandhar Improvement Trust, Jalandhar which he identify to be of the said Chairman. Photo Copy of said Agreement is on our record which is as per the Original. He has heard the statement of Smt.Rajni Rani given today before this Hon'ble Commission which is correct.

So accordingly, in view of the statement suffered by Smt.Rajni Rani, DH along with his Counsel Sh.V.K.Singla, Advocate, the present execution application is dismissed as withdrawn being fully satisfied. As per Order dated 13.07.2021 of this Commission, Warrant of Attachment if already issued, be recalled back un-executed forthwith as per agreement-cum-compromise dated 10.08.2021 between the parties. The Parties be made to remain bound by the said agreement is Ex.C-1. File be consigned to the record room.
