Complaint Case No.63 of 2023.

Shyam Lal Vs. Jaipur Hospital.

Present:     Sh. Ashutosh Sharma, Adv. for the complainant. 

                Today the case is fixed for consideration on the point of maintainability.  The complainant has alleged in the complaint that he had gone to Jaipur Hospital for treatment of Hemorrhoids in the year 2021 and was treated by OP No.2 as they advertised that they are the best in treatment of hemorrhoids/piles and was admitted in the hospital and operated upon 14.03.2021 but due to the negligence of OP No.2, the complainant started heavy bleeding and despite medicines, bleeding could not be stopped.  He again visited the Jaipur Hospital and contacted OP No.2 again but he lingered on the matter by saying that it is natural.  The complainant contacted the another hospitals in Kaithal and lastly, he was operated in Saraswati Hospital for three times, then the bleeding was stopped and during this period, the complainant was operated more than 10 times and lost lots of blood.  After this, he contacted again OP No.2 for what he did to him but OP No.2 flatly refused the claim of complainant.    

                We have perused the case file.  As per report of District Medical Board for Negligence, Kaithal dt. 28.10.2021, which is Mark-A on the file, abstract of which is mentioned at page No.23 wherein it is clearly mentioned by the committee of four doctors that there is no medical negligence on the part of Jaipur Hospital-OPs.  There is no document on the file which could show that there is medical negligence on the part of OPs.  During the course of arguments, the complainant

has failed to show any deficiency in service on the part of OPs.  So, we dismiss the complaint at the time of admissibility of the complaint.  A copy of this order be sent to the complainant free of cost.  File be consigned to the record room after due compliance.
