A defective petition was filed. Petitioner who was appearing in person in spite of two adjournments given to him did not remove the defects. Office had listed this case before the Bench on 31.1.2012 for passing appropriate orders. On the said date petitioner appeared in person. On a request made by him, case was adjourned for today. It was made clear that in case the defects are not removed, no further opportunity shall be granted to him to remove the defects.

As per office report, defects have not been removed. Petitioner has sent a letter in Hindi stating therein that he is suffering from Asthma and Piles and his wife has undergone stone operation because of which he will not be in a position to appear. He has sought adjournment.

No ground for adjournment is made out. Sufficient opportunity has been granted to the petitioner to remove the defects.

Dismissed for non-prosecution.
