Present: Counsel for the Appellant Sh. Avdhish Kumar along with   Ms. Ranjana Devi, Appellant in person.

 

      Appellant wants to make a statement. Let it be recorded.                 Statement of Ms. Ranjana Devi, the Appellant on Oath:

      I had paid an amount of Rs. 36,000/- to Professor Yogesh Kumar working in Indraprastha Institute of Technology, Sahibabad for onward payment in Singhania University, Pachedi Badi, Rajasthan, for the purpose of my enrolment as PHD Scholar. I wanted to pursue Doctorate in Singhania University. After a period of 3 ½ years, I was informed orally by the University authorities that an amount of Rs. 36,000/- was not received by the University. I was asked to deposit an amount of Rs. 1.75 Lac in one shot by the University. I did not deposit the same. I was orally informed not to come to University for any guidance for may doctorate.

        We have perused the statement made by the Complainant Ms. Ranjana Devi. It is clear case of cheating by Professor Yogesh Kumar, as alleged. The Complainant/ Appellant had been gullible in that she had a blind faith in Professor Yogesh Kumar who kept on misguiding the Complainant. The grievance of the Complainant/Appellant is directed against Professor Yogesh Kumar and not against Singhania University. It may be mentioned here that Professor Yogesh Kumar is a Teacher in Indraprastha Institute of Technology, Sahibabad and has no connection with Singhania University, Rajasthan. For these reasons, we are of the considered opinion that the matter does not come within the purview of ‘Consumer Protection Act’. The complaint was wrongly drafted with a view to bring it within the ambit of ‘Consumer Protection Act’. Appeal too is hence not maintainable. Appeal is accordingly dismissed in limini. File be consigned to record room.
