            Today is fixed for further hearing on the point of admission. The complainant files hazira along with a petition, duly verified praying for passing order to withdraw the case with permission to file the case afresh on the self-same cause of action on the ground that the complaint petition suffers from technical defects.

            The petition is moved. We have carefully perused the complaint petition and the document filed with the complaint. We are of the opinion that the technical defects as pointed out by the ld. Advocate of the complainant shall not be removed by way of amendment. In the above premises the prayer of the complainant should be allowed. Hence, it is

that the petition filed by the complainant is allowed. Accordingly the complainant is prmitted to withdraw the case with liberty to file the case afresh on the self-same cause of action.
