ORDER

Complainant/respondent was sold a tractor for Rs.17,91,598.50, which could not be got registered and put on road.  Respondent suffered loss as he could not use the tractor.  For the deficiency in service on the part of the appellant, State Commission directed the appellants to pay a sum of Rs.2 lakh to the respondent as compensation within one month from the date of receipt of the copy of the order failing which interest @ 9% was to be paid from the date of purchase of the vehicle till realization.  Rs.10,000/- were awarded by way of costs.

 

        State Commission has passed an elaborate order.  Plea taken by the appellant before the State Commission that the appellant had informed the respondent that the vehicle could not be got registered and put on road was made known to the respondent has not been accepted by the State Commission.

 

        We agree with the view taken by the State Commission.  Nobody would buy a vehicle for a sum of nearly Rs.18 lakh, which cannot be got registered and put on road.  It is clearly a case where a person has been duped.  Dismissed.
