Heard Smt. Anjali Gusain, learned counsel for the applicant through video conferencing.

This miscellaneous application has been filed by the applicant for release of mandatory deposit of amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only), which was deposited by the applicant in First Appeal No. 193 of 2018; Agriculture Insurance Company of India Ltd. Vs. Sh. Jagtar Singh. 

Facts giving rise to this miscellaneous application in brief are that the aforesaid appeal was preferred by the applicant against judgment and order dated 27.10.2018 passed by the District Commission, Dehradun in consumer complaint No. 54 of 2015 and 12 other consumer complaints, by which the consumer complaint was allowed.  The aforesaid appeal was dismissed by this Commission vide judgment and order dated 13.02.2019. 

Revision Petition No. 994 of 2019; Agriculture Insurance Company of India Ltd. Vs. Sh. Jagtar Singh was preferred by the applicant before the Hon’ble National Commission, which has been decided vide judgment and order dated 14.01.2020.  Copy of aforesaid judgment and order passed by the Hon’ble National Commission has been filed by the applicant.  According to office report dated 15.07.2021, aforesaid judgment and order dated 14.01.2020 passed by the Hon’ble National Commission is available on website.  Hon’ble National Commission has set aside the judgment and order passed by this Commission as well as District Commission. 

Consequently, the aforesaid amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only), deposited by the applicant before this Commission towards mandatory deposit at the time of filing the appeal, be released in favour of the applicant.  Accordingly, the miscellaneous application is disposed of.
