JUDGMENT

Per Sri Sushil Kumar,  Member- This appeal has been filed against the judgment and order dated 27.8.2016 passed by the ld. District Forum, Hamirpur in complaint case no.55 of 2015, whereby the bills in question were cancelled and appellants were directed to pay  Rs.3,000.00as damages and Rs.2,000.00 as cost of the case to the complainant.

          As per the case of the complainant, he deposited the electricity connection fees under Rajiv Gandhi scheme. The electricity department issued electricity connection but no electricity was supplied and issued the electricity charges bills illegally. Therefore, complaint was filed against the electricity charges and for other consequentional reliefs.

          The appellant contended that electric supply was made just after issuance of electric connection and electric bills were issued as per rules.

          It is admitted fact that the complainant deposited Rs.250.00 in the years 2008 to 2010 but the complainant never made any complaint regarding non-supply of electricity to any authority. Therefore, this fact may be presumed that

complainant consumed the electricity and he is under obligation to pay the electric charges. Therefore, the appeal deserves to be allowed.

ORDER

          Appeal is allowed. The judgment and order dated 27.8.2016 passed by the ld. District Forum, Hamirpur in complaint case no.55 of 2015 is hereby set aside. The complaint is dismissed.

          Certified copy of this judgment be provided to the parties as per rules.
