By this revision petition, Delhi Jal Board, the appellant before the State Consumer Disputes Redressal Commission, Delhi in F.A. No.377/2013 impugns order dated 12.11.2013, whereby the State Consumer Disputes Redressal Commission, Delhi has dismissed the appeal in default. Learned counsel appearing for the petitioner submits that as per the practice followed by the State Commission, after filing of the appeal, the date of hearing of the appeal is notified on the internet. She states that though as per the website, the date of hearing was notified as 12.11.2013 but inadvertently she noted down the date of hearing in her diary as 13.11.2013, with the result that she did not appear before the State Commission on 12.11.2013. The petition is also supported by affidavit of the counsel herself. Having heard learned counsel, we are of the view that the interests of justice demand that an opportunity of hearing should be afforded by the State Commission to the petitioner. Accordingly, we set aside the impugned order and restore the aforesaid appeal to the file of the State Commission for disposal on merits. The petitioner/its counsel is directed to appear before the State Commission on 27.1.2014 for further proceedings. Revision petition stands disposed of accordingly. |
