UDAYABHANU : PRESIDENT The appellant is the opposite party/HDFC Bank in CC:119/08 in the file of CDRF, Pathanamthitta. The appellants are under orders to pay a sum of Rs.1000/- with interest at 9% per annum from the date of order and also to pay compensation of Rs.2000/- and cost of Rs.1000/-. The appellant stood exparte before the Forum. The appellant has sought for an opportunity to get the matter contested before the Forum. In the circumstances the order of the Forum is set aside on condition that the appellant deposit a sum of Rs.5000/- before the Forum within 45 days from today. The amount can be withdrawn by the complainant. On deposit of the amount the Forum will permit the opposite party to file version and contest the matter. The Forum shall dispose of the matter within 4 months. The Forum shall issue notice to the complainant. The matter stands posted before the Forum on 31A..8..2009. The appellant is permitted to withdraw Rs.25,000/- deposited vide DD.002170, dtd:14..5..2009. The office is directed to despatch copy of this order to the Forum below urgently.
