The complainants have entered into an agreement with the opposite parties for cultivating plantain in the property of the opposite parties. After the cultivation, the opposite parties restrained the complainants from entering into the property, demolished and destroyed the plantain trees grown by them. They also electrified the fencing in order to make danger to the life of the complainants by electric shock.
So we think that eventhough the petition is filed for compensation, the matter pertaining the same is not at all maintainable before this Forum, because the same is absolutely a civil and criminal dispute. It is not proper to consider the matter, because the same is not comes in the purview of the definition of Section 2D of the Consumer Protection Act, 1986. So the complainants are directed to return the same and the documents for filing before the appropriate authority if so advised.
