The contention of the complainant is that complainant purchased “Maruti Alto 800 LXI BS IV” at a Rs.3,80,552/- from OP dealer Maruti Suzuki Pvt. Ltd. Malda on 11/03/2016 as rood price. The OP issued invoice copy and insurance certificate to carry out the vehicle on received of money. OP inform to complainant to collect registration certificate and other relevant paper from their office after receiving the registration conformation massage and thereafter to contact with RTO Malda for number plate. Afterwards when complainant got registration conformation massage went to the office of OP to get registration certificate, but he was informed that certificate was not ready. Now on the lack of all papers of vehicle, complainant was unable to drive vehicle. On 16/09/2022 complainant gave a legal notice to deliver registration certificate and other documents within 15 days but no answer came. So this performance of OP is a gross negligence and deficiency of service and unfair trade practice. Hence he approaches before this commission to get Rs.2,00,000/-for incurred to hire another car and for legal expenses Rs.3,000/- and for mental agony Rs. 1,00,000/- total Rs. 3,03,000/-.
OP did not appear to contest the case, hence ex-parte arose.
Complainant examined himself in writing following the compliant petition.
Decision:
Perused the unchallenged testimony of the complainant and perused invoice of the vehicle. Perused the lawyer-notice given on behalf of the complainant.
Form the complainant petition, affidavit as well as lawyer-notice we the commission found that the complainant did not disclose about the details of papers which he did not get from the OP save and except the registration certificate. Accordingly as per prayer of complainant this commission is directing the OP to deliver registration certificate to the complainant/ customer within two month from the date of this order. This commission is also directing to pay Rs. 3,000/- as litigation cost to the complainant and to pay Rs.20,000/- for his mental agony and inconvenience. But this complainant is not entitle to be granted any hiring car as traveling expenses, on the dearth of proper proof, that is receipts etc. and non availability of any conveyance for his allege journey.
Hence ordered
that the complaint petition is allowed to the effect that the OP is directed to handover registration certificate behind the vehicle “Maruti Alto 800 LXI BS IV” purchased on 11/3/2016 to the complainant within two month from this order and to pay litigation cost Rs.3,000/- and Rs.20,000/- for mental agony during these years (2016-2023).
No order of cost is made.
